Terms And Conditions

This Terms of Service ("Agreement") is entered into by and between Plutope, a private limited company incorporated in India ("Company," "we," or "us"), and the user ("User," "you," or "your") accessing and utilizing Wallet/Card Services ("Service"). By accessing or using the Service, you agree to be bound by the terms and conditions of this Agreement. Please read these terms carefully before using the Service. If you do not agree with any part of this Agreement, do not access or use the Service.
This Agreement outlines the terms and conditions governing your use of the Service, including but not limited to the use of our website, mobile applications, and any related content, features, or services. Your use of the Service constitutes your acceptance of and agreement to abide by these terms.

KEY DEFINITIONS

Service

Encompasses all products, features, functionalities, and services provided by the Company, including but not limited to the creation, management, and use of digital cryptocurrency wallets, secure storage of cryptographic keys, and associated tools and technologies.

User

Any individual or entity accessing or utilizing the Company's Service, including clients, customers, and visitors interacting with the Company's website, applications, and related platforms.

Crypto Wallet

A digital platform provided by the Company enabling Users to store, manage, send, and receive various cryptocurrencies and digital assets. A Crypto Wallet consists of cryptographic keys, which include a private key for authorizing transactions and a public key for receiving funds.

Digital Asset

An asset that is issued and transferred using distributed ledger or blockchain technology including but not limited to virtual currencies, coins, and tokens.

Fees

The charges applicable to Users for various services provided by the Company, such as transaction fees, storage fees, and service fees, as outlined in the Company's fee schedule.

Parties

Collectively refers to the Company and the User(s) involved in the Agreement.

Agreement

This document, including all clauses, terms, conditions, and incorporated policies, governing the relationship between the Company and Users in relation to the use of the Service and Crypto Wallet.

ACCEPTANCE OF TERMS

By registering on Plutope, you acknowledge that you have read, understood, and agree to abide by our Terms of Service, Privacy Policy, and any other rules and policies that Plutope may publish from time to time. Failure to comply with these terms may result in the termination of your access to our services.

CONDITIONS FOR REGISTRATION

Identity Verification:

During the registration process, you will be asked to provide certain information for the purpose of identity verification. You consent to provide accurate, complete, and updated information about yourself. It is your responsibility to ensure that this information remains current, accurate, and complete at all times. You agree to promptly inform us of any changes to your registration information.

Account Sharing Prohibited:

Sharing your Plutope account with others is strictly prohibited. Your account is intended for your individual use only. You are responsible for all activities that occur under your username and account.

Security of Credentials:

You are solely responsible for maintaining the confidentiality of your account. You understand that you are fully accountable for any actions, authorized or unauthorized, that occur using your account credentials. Plutope shall not be liable for any loss, damage, or consequences arising from the use or misuse of your account.

Access Restriction:

Plutope reserves the right, at its sole discretion and judgment, to refuse, suspend, or deny your access to all or any portion of our services. This may occur if we believe that you have violated our Terms of Service, engaged in unauthorized or inappropriate activities, or for any other reason deemed necessary to protect the integrity of our platform.
By registering and using Plutope’s services, you acknowledge your acceptance of these terms and agree to adhere to them throughout your use of our platform. It is your responsibility to review these terms periodically for any updates or changes. Your continued use of Plutope constitutes your ongoing agreement to these terms and any modifications that may be made to them. It is important to understand that these third-party services are provided solely for convenience and as a supplementary component of our platform. By choosing to engage with or utilize any third-party service, you acknowledge and agree to the following terms:
  • Plutope disclaims any and all responsibility, liability, and accountability with respect to any third-party service, content, information, data, or materials that are accessible or provided through our platform. This includes, but is not limited to, any information that may be misleading, incomplete, erroneous, offensive, indecent, or otherwise objectionable, either to you or as determined by applicable laws in your jurisdiction.
  • The decision to rely on or utilize third-party content or services is entirely at your own discretion and risk. You acknowledge that your engagement with any third-party service is voluntary and that you are solely responsible for evaluating the accuracy, completeness, and suitability of such services for your individual needs.
  • The inclusion of third-party services on the Plutope platform does not constitute an endorsement, sponsorship, or affiliation of such services by Plutope, unless explicitly stated otherwise. We do not control or oversee the activities, policies, practices, or content of these third-party providers.
  • To the fullest extent permitted by applicable law, Plutope shall not be liable for any direct, indirect, consequential, incidental, special, or punitive damages arising from or related to your use of any third-party service, content, or materials. This includes, but is not limited to, financial losses, data breaches, loss of business opportunities, or any other damages.
  • Cardholders can utilize the Card for international remittances, allowing them to transfer funds across borders efficiently.
  • The Card can be used for cash withdrawals from ATMs within the limits as specified by Mastercard.
  • The Card can be used for other functionalities as determined by the Mastercard.

MOBILE APPLICATIONS

APPLE APPLICATION

If the Services that you access and use is an Apple Application: the Apple Application may be accessed and used only on a device owned or controlled by you and using the Apple iPhone OS;

You acknowledge and agree that:

Apple has no obligation at all to provide any support or maintenance services concerning the Apple Application. If you have any maintenance or support questions concerning the Apple Application, please contact us, not Apple, using the contacting us details at the end of these Terms of Use; Although these Terms of Use are entered between us and you (and not Apple), Apple, as a third-party beneficiary under these Terms of Use, will have the right to enforce these Terms of Use against you;  except as otherwise expressly set out in these Terms of Use, any claims relating to the possession or use of the Apple Application are between you and us (and not between you, or anyone else, and Apple); and  in the event of any claim by a third party that your possession or use (in accordance with these Terms of Use) of the Apple Application infringes an intellectual property rights, Apple will not be responsible or liable to you concerning that claim;

You represent and warrant that:

You are not, and will not be, located in any country that is the subject of a Government embargo or that has been determined by the Government as a "terrorist supporting" country; and you are not listed on any Government list of prohibited or restricted parties; and If the Apple Application that you have purchased does not conform to any warranty applying to it, you may notify Apple, which may then refund the purchase price of the Apple Application to you. Subject to that, and to the maximum extent permitted by law, Apple does not give or enter into any warranty, condition, or other term concerning the Apple Application and will not be liable to you for any claims, losses, costs, or expenses of whatever nature concerning the Apple Application or as a result of you or anyone else using the Apple Application or relying on any of its content.

Android Applications

If the Services that you access, and use an Android Application: the Android Application may be accessed and used only on a device owned or controlled by you and using an Android OS;

You acknowledge and agree that:

Google has no obligation at all to provide any support or maintenance services concerning the Android Application. It is your responsibility to review this Agreement periodically to stay informed about any revisions.

Communication of Changes

While it is incumbent upon you to review this Agreement for updates, Plutope is committed to using commercially reasonable efforts to communicate material changes to this Agreement through the Plutope website or other relevant communication channels. We aim to keep you well-informed about any significant alterations that could impact your relationship with our services.

User's Responsibility

As a user of Plutope's platform, you acknowledge and agree that it is your responsibility to stay informed about any changes, modifications, or updates to our services and this Agreement. We recommend that you regularly review our platform and associated communications to ensure that you are up-to-date with the latest information.

Continued Use and Acceptance

Your continued use of our services following changes to the Agreement or our services constitutes your acceptance of those changes. If you do not agree with any modifications, we advise you to cease using our services.

ELIGIBILITY

By accessing and using the services provided by Plutope, you affirm that you meet the eligibility criteria outlined in this clause.
  • You must be at least 18 years of age to access and use Plutope's services. By agreeing to these terms, you confirm that you are 18 years old or older. If you are not of legal age, you are not eligible to use our services, and any use of the platform is considered a violation of these terms.
  • By accessing and using our services, you represent and warrant that you are legally permitted to do so under the laws of the country in which you are a resident or from which you access and use the services and website. It is your responsibility to ensure compliance with the relevant legal requirements in your jurisdiction.
  • You acknowledge and understand that Plutope is not liable for any consequences or legal issues arising from your failure to comply with the age restrictions or legal requirements of your jurisdiction. It is your obligation to refrain from using our services if you do not meet the eligibility criteria outlined in this clause.
  • If you do not meet the specified eligibility criteria, you are prohibited from accessing and using Plutope’s services and website. By accessing and using our services, you confirm that you meet the eligibility requirements and agree to be bound by these terms. Plutope reserves the right to verify your eligibility and take appropriate action if it is determined that you do not meet the specified criteria.

TRADING RISKS

Plutope provides a wallet service that allows you to securely store, use, sell, or purchase cryptocurrencies. It's important to understand that while we offer a secure and convenient platform for managing your cryptocurrencies, there are inherent risks associated with trading and using cryptocurrencies such as Cryptocurrency Volatility, Market Risks, Lack of Regulations, Security Concerns, Technical Risks, User Responsibility, Loss of Funds. By using Plutope's wallet services, you acknowledge and accept the risks outlined in this trading risk caution. While we strive to provide a secure and reliable platform, it's essential to recognize that trading and using cryptocurrencies carry inherent risks. You should only invest or transact with funds that you can afford to lose and exercise caution when making financial decisions involving cryptocurrencies. Plutope shall not be held liable for any losses, damages, or consequences arising from your use of our wallet services or the trading of cryptocurrencies.

INVESTMENT ADVICE

Any information provided by Plutope, including but not limited to articles, guides, analyses, market trends, and insights, is intended for informational purposes only. It does not constitute financial, investment, legal, or tax advice, and should not be interpreted as such. Plutope does not provide investment recommendations or personalized financial advice. he information provided by Plutope is offered without any express or implied warranty of any kind, including warranties of accuracy, completeness, or fitness for any particular purpose. Any decisions you make based on the information provided by Plutope are at your own risk. You are solely responsible for evaluating the accuracy, completeness, and relevance of the information provided by Plutope. Your investment decisions should be based on your individual financial situation, risk tolerance, and investment goals. TAXES

It is under your responsibility to determine what taxes apply to the trades you complete and to report and remit the correct tax to the appropriate tax authority.

PAYMENTS, REVERSALS, AND CANCELLATIONS

  • All payments for Plutope's services must be made exclusively through the payment methods explicitly specified by Plutope on its official website or authorized communication channels.
  • Plutope reserves the right to verify the validity of the payment methods used by the User. In the event that a payment method cannot be verified or is found to be invalid or otherwise unacceptable, Plutope retains the right to cancel or suspend the associated payment and/or services without liability.
  • Once an order or transaction has been marked as complete by Plutope, it cannot be canceled, reversed, or modified by the User. The User acknowledges that completed transactions are final and binding.
  • If the User violates any of the terms of this Clause or any other terms and conditions set forth by Plutope, Plutope reserves the right to terminate or suspend the User's access to its services, including the cancellation of any ongoing or pending transactions, without prejudice to any other remedies available to Plutope.

FEES

While Plutope does not charge any fees at present, the company may decide to implement fees for its services at a later date. These fees could include transaction fees, account maintenance fees, withdrawal fees, or any other charges deemed necessary by Plutope. Any such fee implementation will be communicated to Users through official communication channels, including the Plutope website and user notifications.

COMMUNICATION

  • Plutope does not require Users to provide personal information such as email addresses for the purpose of safeguarding identity within the application. All necessary communications, alerts, and updates will be made available directly through the Plutope application itself.
  • Users can expect to receive notifications, alerts, and messages within the Plutope application's interface. These communications will include important information, updates, security notifications, and any other relevant content related to Plutope's services.
  • While Plutope does not require personal information like email addresses for communication, Users have the option to provide their email addresses voluntarily. If a User chooses to provide their email address and specifically requests to receive communications through that channel, Plutope may send occasional communications to the provided email address. However, the primary mode of communication will still be within the application.

COPYRIGHTS AND OTHER INTELLECTUAL PROPERTY RIGHTS

Plutope, as the creator and provider of innovative cryptocurrency services, asserts and safeguards its intellectual property rights. All copyrights, patents, trademarks, trade secrets, and any other forms of intellectual property rights associated with Plutope's services, products, designs, content, software, and technologies, whether registered or unregistered, are and shall remain the sole and exclusive property of Plutope. While using Plutope's services, users are granted a limited, non-exclusive, non-transferable license to access and utilize the intellectual property owned by Plutope solely for the purpose of engaging with the services as intended. This license does not grant users the right to reproduce, distribute, modify, create derivative works, reverse engineer, or otherwise exploit Plutope's intellectual property without explicit written consent. Users of Plutope's services shall not gain any ownership or proprietary rights to any of Plutope's intellectual property by using the services, regardless of any contributions or interactions with the platform.

LIMITATION OF LIABILITY

  • Plutope shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including, but not limited to, loss of profits, revenue, data, or other intangible losses, arising out of or in connection with the use of Plutope's services.
  • Plutope shall not be liable for any damages resulting from the actions or omissions of third parties, including but not limited to other users, service providers, or external entities.
  • Plutope shall not be liable for any failure to perform its obligations or any delay or disruption in service due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, acts of terrorism, war, strikes, labour disputes, governmental actions, and other similar events.
  • Plutope, a cryptocurrency wallet storage company ("Plutope"), provides its services to you ("User") on an "AS IS" and "AS AVAILABLE" basis, and without any express or implied warranties. Plutope's services, including its website, software, applications, and any related content, are provided without any warranties of any kind, whether express or implied. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, security, or availability.
  • Plutope's services may include faults, defects, errors, or inaccuracies. There is no guarantee that the services will be free from errors or that any defects will be corrected. You understand and accept the risks associated with using Plutope's services.
  • Plutope's services may include content, links, or references to third-party websites, applications, or resources. Plutope does not endorse, control, or assume responsibility for the content or practices of third-party entities. Your use of such third-party content is at your own risk, and Plutope disclaims any liability for any resulting issues.
  • Plutope does not warrant the security of your data or transactions on its platform. While Plutope employs security measures, there is no absolute guarantee against unauthorized access, data breaches, or other security incidents

INDEMNIFICATION

By using the services provided by Plutope, a cryptocurrency wallet storage company ("Plutope"), you ("User") agree to indemnify and hold harmless Plutope, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of Plutope's services. This indemnification applies to any third-party claims, actions, or demands, as well as any violations of these terms of use or applicable laws.

DISCONTINUANCE OF SERVICES

Plutope retains the right to discontinue, suspend, or terminate any or all of its services, features, or functionalities without prior notice. This may occur due to various reasons, including but not limited to changes in business strategies, regulatory requirements, technical limitations, or other unforeseen circumstances.

GOVERNING LAW

This agreement shall be governed by and interpreted in accordance with the laws applicable in India. Any disputes arising from or relating to this agreement shall be subject to the exclusive jurisdiction of the competent courts in India.
